    Hours of wedding coverage with two photographers for wedding day as outlined above.
  • Services Agreed Upon: _______hours of wedding coverage with two photographers for wedding day as outlined above. You will receive approximately 40 edited digital images per hour of coverage. Photos will be edited for skin retouching and stylized color effects at the photographer’s discretion. A print release will be included so you’re able to print at your own will. The images will be given to you via a printed USB Drive. Your images will be completed approximately 8 weeks after the event. Please note that all images posted online on Facebook or other networking sites, should be accredited to Acapello Photography.

    1. The Client shall assist and cooperate with the Photographer in obtaining the desired photographs, including but not limited to supplying a shot list and/or specifying persons and/or scenes to be photographed; taking time to pose for photographs at the Photographer’s direction; pre-shoot consultations; etc. Photographer shall not be responsible for photographs not taken as a result of Client’s failure to provide reasonable assistance or cooperation. The client agrees to give the photographer ample notice, in order to prepare, of key events such as bouquet throwing, cake cutting, speeches etc.

    2. In any case that the wedding does not run on time (for example: extreme lateness of one of the clients) which postpones events, we cannot guarantee to take our normal set of photos, however, in such circumstances we will do our best to compensate.

    3. Many attending guests will have digital cameras and will want to photograph the clients. The Client agrees to give the Photographers precedence over the guests in order to take the photos as outlined above. We cannot be liable for lack of wedding photos due to guests taking their own photos continually interrupt the Photographer’s work.

    4. If the photographers are working during dinner, they must be included in the dinner/ plate count (2). Photographers will break to eat during dinner and resume shortly thereafter. Dinner time will be included in the total number of hours of service.

    5. The photographer retains copyright to the photographs, and hereby grants the Client unlimited but non-exclusive rights to use or reproduce the photographs for which the client pays. A print release will be provided to the Client for purposes of printing photos. Photographs shall be delivered to the client via digital download, USB, or any other media deemed suitable by the Photographer. Client is prohibited from further editing of images in any form. Client is also prohibited from using photos in contests without written consent from Acapello photography. Client may not, for any reason, sell their images to any third party.

    6. If the client completes an engagement session but continues to cancel their wedding contract with Anthem Country Club for any reason, a session fee of $450 is owed directly to Acapello Photography. If the client cancels the wedding within 90 days from their wedding date, an additional cancellation fee of $1000 is owed directly to Acapello photography, and considered liquidated damages.

    7. The Client and Subjects hereby grant Acapello photography the right to use and publish photographs from this session for editorial purposes, advertising, and web content, and authorize the Photographer to use and publish the same in print and/or electronically.

    8. The client understands that the photographer will store images on file for up to one year past their wedding for ordering purposes only. Any and all product orders shall be done within that time.

    9. In the unlikely event that the Photographer is injured or becomes too ill, or has an extreme emergency that prevents him or her from photographing the event, the Photographer will make every effort to find a replacement. Under normal circumstances, a second shooter is there for coverage of the wedding day and will then shoot on his/her own. In the unlikely event that neither photographer can attend, and a replacement photographer cannot be found, then liability is limited to a refund of any payments received. The photographers have working methods in place to prevent loss or damage of your items. However, there is an unlikely possibility that images may be lost, stolen or damaged for reasons in or beyond their control. In these circumstances, liability is limited to return of fee paid for the service or part thereof according to the percentage of images supplied.

    10. In the event that the client cancels wedding for whatever reason, the retainer fee is non-refundable. It will be considered as liquidated damages to the photographer.

    11. The Photographer shall be held harmless for any injuries to The Clients of participants or damage to the clients equipment during the course of the photo session and the immediately surrounding events. Photography in uncontrolled outdoor environments can be unpredictable and The Photographer assumes no liability. Please be aware of where you keep your belongings and check at the end of the session so nothing is left behind. The Photographer is not liable for any items misplaced, lost or left behind by The Clients/participants. The client is liable for all damages caused by client or guests towards member(s) of Acapello Photography or their equipment. However, Acapello Photography will be held liable for any damages caused by their equipment, members, and/or actions.

    12. Impossibility
    Force Majeure
    No party shall be liable or responsible to the other party, nor be deemed to have defaulted under or breached this Agreement, for any failure or delay in fulfilling or performing any term of this Agreement (except for any obligations to make payments to the other party hereunder), when and to the extent such failure or delay is caused by or results from acts beyond the impacted party’s (“Impacted Party”) control, including, but not limited to, the following force majeure events (“Force Majeure Events”): (a) acts of God; (b) a natural disaster (fires, explosions, earthquakes, hurricane, flooding, storms, explosions, infestations), epidemic, or pandemic; (c) war, invasion, hostilities (whether war is declared or not), terrorist threats or acts, riot or other civil unrest; (d) government order or law; (e) actions, embargoes or blockades in effect on or after the date of this Agreement; (f) action by any governmental authority; (g) national or regional emergency; (h) strikes, labor stoppages or slowdowns or other industrial disturbances; and (i) shortage of adequate power or transportation facilities. The Impacted Party shall give Notice within 30 days of the Force Majeure Event to the other party, stating the period of time the occurrence is expected to continue. The Impacted Party shall use diligent efforts to end the failure or delay and ensure the effects of such Force Majeure Event are minimized. The Impacted Party shall resume the performance of its obligations as soon as reasonably practicable after the removal of the cause. In the event that the Impacted Party’s failure or delay remains uncured for a period of 90 days following Notice given by it, the other party may thereafter terminate this Agreement upon Notice.

    13. Failure to Perform Services

    In the event Acapello Photography cannot or will not perform its obligations in any or all parts of this Agreement, it (or a responsible party) will:

    Immediately give Notice to Client via the Notice provisions detailed in this Agreement; and Attempt to find another competent professional to take its place with the mutual agreement of Client(s); If another competent professional is not available or Client(s) do not agree to transfer of obligations to said alternate professional, Acapello Photography will issue a refund or credit based on a reasonably accurate percentage of services rendered; and Excuse Client(s) of any further performance and/or payment obligations in this Agreement.

    14. Appropriate Conduct/ Safe Working Environment Health & Safety

    Client(s) further understand that Acapello Photography complies with all health and safety laws, directives, and rules and regulations. Client(s) expressly agree(s) that during the [event/wedding/session] Client(s) and Client(s)’ agents shall not carry weapons or firearms, be exposed to severe illness, or request Acapello Photography to do anything illegal or unsafe. Further, Acapello Photography will not provide services in any location or area deemed to be unsafe in its sole discretion, including, but not limited to, areas affected by communicable diseases, quarantined areas, or other similar occurrences. Under any of these circumstances, Acapello Photography reserves the right to end service coverage immediately and/or leave the [event/wedding/session]. Acapello Photography shall be entitled to retain all monies paid and Client(s) agree to relieve and hold Acapello Photography harmless as a result of incomplete event coverage, or for a lapse in the quality of the Acapello Photography's work.
    The signature of the photographer represents and confirms that he/she will deliver every service as agreed upon. • The signature of the client confirms that he/she has read the agreement details and agrees with EVERY clause. • The client is required to pay a retainer fee of 25% of the event cost (nonrefundable) at the signing in order to reserve the date. • Payment is accepted in the form of cash or checks made out to Amanda Capello (invoice can be sent upon request). • The balance must be paid in full two weeks before the day of the event otherwise the photographer(s) will not pursue necessary actions required. • Bounced checks are the client’s responsibility and an additional fee of $50 will be added to the total amount for the inconvenience. • For services outside the United States, wire transfers will be the only accepted method of payment and additional details will be provided if applicable. • Services will be provided for the exact time agreed; to receive services past the agreed time, the required fee is $400/hour billed after 15 minutes past the agreed end time. • There will not be any refunds issued once the contract is signed. • Acapello Photography will not work simultaneously with another photography company. If this occurs, services will not be rendered and no refunds will be made.
